American Water Company. Defendant/Counterclaimant asked the first
questions before the taxpayers at the packed Tivoli Theater and
also charged the Mayor, the Public Works Department, and City
Council with protecting and covering up the hazardous waste dumping
operation. The Mayor and City Council were outraged at
Defendant/Counterclaimant's charges. Defendant/Counterclaimant
revealed that city councilman John Lively was the chief salesman
for the dumper "Foxworth" and that City Councilman Don Eaves had
refused to allow Defendant/Counterclaimant to address a scheduled
Tuesday meeting of the City Council, and that the reason Councilman
Eaves had not allowed Defendant/Counterclaimant to address the City
Council was in order to keep the people of Chattanooga from finding
out about the illegal hazardous waste dumping. When
Defendant/Counterclaimant announced at the Tivoli Theater meeting
that Councilman Eaves had stated his reason for not allowing
Defendant/Counterclaimant to address the City Council was that "we
go out on the air..." and "You see this goes out before the
cameras", Councilman David Crockett immediately denied that
Councilman Eaves ever made such a statement.
Defendant/Counterclaimant explained to the taxpayers that
Councilman Eaves' statements were tape-recorded and
Defendant/Counterclaimant then accused Councilman Crockett of lying
to the people When Defendant/Counterclaimant concluded his
remarks, a thunderous standing ovation of applause from the
audience, which lasted for approximately 20 seconds, was also tape
