RE: COVER-UP of Illegal Hazardous Waste Dumping,
Bank Fraud, Conspiracy, RICO Operation in Chattanooga
by City, County, and State Officials.
Dear Chief Parks:
Please find enclosed my Certified Letter of July 5, 1998 to former
Chattanooga Chief of Police Jimmy Dotson, describing criminal activity
in Chattanooga that has been allowed and protected for the past 14
years. As you may recall, in September of 1990, I appeared at your
office in Internal Affairs, and gave a tape recorded deposition to you
in the presence of Eugene "Bunky" Wright regarding my knowledge of
illegal dumping activities at Hydro-Vac Services, Inc. Tape
recordings of your investigation of William Foxworth while under oath
with his lawyer, William Colvin, prove absolutely that they were fully
aware the treatment plant design at Hydro-Vac was specifically rejected
by City Systems Engineer, George Kurz. Yet, in 1991, Colvin and
Foxworth conspired to defraud the First Tennessee Bank in obtaining
a $900,000 loan using the rejected treatment plant as collateral for
the loan. When I brought these revelations to the attention of bank
loan officer Ronald Baldwin, Foxworth conspired with city pretreatment
coordinator Rick Tate, to trick newly hired systems engineer,
Alice Cannella, into renewing Hydro-Vac's permit. Tate admits in
correspondence to Jack Marcelles, that Kurz had rejected the plant
design. With full intention to deceive Alice Cannella, Tate brought the
renewal permit for her signature renewing a permit that did not exist
and allowing Alice Canella to think that Hydro-Vac's treatment plant
was operating under George Kurz's approval.
In a tape recorded conversation between myself and Alice Cannella in
1991, I specifically asked her what she had to do with Hydro-Vac's
treatment plant design. She stated "... Oh I had nothing to do with the
design approval, they were already up and operating when I got here."
In 1992, First Tennessee loan officer Ronald Baldwin, with full
knowledge of the fraudulent loan, did knowingly and intentionally
conspire with Foxworth and Colvin to transfer the fraudulent loan
to the U.S. Small Business Administration (SBA).
This money was used to allow Foxworth to continue his illegal dumping
activity that has now contaminated Little Debbie® products baked in the
Chattanooga area by McKee Foods Corporation and has dumped
Walmart's hazardous used oil from 350 auto stores in the southeast
into the Tennessee River. The money continues to allow Foxworth to
send hazardous wastes to Alabama through his illegally operated
transfer station at Hydro-Vac Services. His crimes against the people
of Chattanooga and his violations of city, state, and federal
regulations are ongoing.
Foxworth's violation of the Federal RICO Act has been protected in
Chattanooga by a number of City, County, State, and Federal officials,
including Mayors Gene Roberts and Jon Kinsey, City Councilmen
Don Eaves, Ron Littlefield, and John Lively, State Circuit Court
Judges Samuel H. Payne, Neil Thomas III, and Jackie Schulten,
Assistant City Attorney Ann Shaffer, former Public Works Director
Jack Marcelles, Eugene "Bunky" Wright, Rick Tate and Federal
actors like Federal Judge James H. Jarvis, Federal Prosecutor
Harry Mattice, Federal Bankruptcy Trustees William Sonnenburg,
James R. Paris, and Richard Clippard. Councilman John Lively,
turned out to be the chief salesman for dumper Foxworth.
The details and facts of how this RICO operation has been allowed to
continue for the past 14 years with full city, state, and federal
protection will be fully described in my upcoming book
"Tennesseegate" due to be published in March 2004. If you
look at www.Tennesseegate.com, you will see much of the
manuscript for this very revealing book about Chattanooga, one
of the most corrupt cities in America.
I have proof that the reason for the taxpayers of Chattanooga to
presently be paying double sewer bills each month is because of
illegal dumping by certain businessmen in Chattanooga and the
corrupt way our Public Works Department is being operated
against the people's trust. This has been occurring for years under
the administrations of Mayors Gene Roberts and Jon Kinsey.
I cannot prove at this time if Mayor Bob Corker is a party to this
outrage but I intend to copy him with this letter and demand an
immediate investigation by his office as well.
As my enclosed letter to former Chief Jimmy Dotson states,
the subpoenaed tape recordings of your investigation and
other significant documents were included with my letter to
Chief Dotson.
What you do regarding the criminal activity that has taken place
here in the last 14 years, this continuing conspiracy which tolls the
statute of limitations according to the RICO statutes, will tell the
people of Chattanooga just where you stand. Your recent claims,
and comments by your senior staff suggest that criminal activity in
Chattanooga is going to be prosecuted to the letter of the law. I am
looking forward to see if these claims are genuine, or just
"business as usual" in Chattanooga.
Whatever you do will be reflected clearly and concisely in my
book soon to be published. When the people of Chattanooga
realize the reason they are paying double sewer bills each
month, you may want to be on the right side of this revelation
as well. I expect to hear from you immediately.
